A foreigner can own a house in Indonesia only on Hak Pakai (right of use) land

A landed house owned by a foreigner must sit on Hak Pakai land: either plain Hak Pakai, Hak Pakai granted over someone's Hak Milik by a deed before a land deed official (PPAT), or Hak Pakai over Management Rights land under an agreement with the holder. Apartments (strata units) follow separate rules in the same article. If your contract promises you Hak Milik, or keeps the title in another person's name for you, ask a lawyer before paying.

Arrangements that pass freehold to a foreigner, directly or indirectly, are void

Any sale or other act meant to transfer Hak Milik to a foreigner, directly or indirectly, is void by law, the land falls to the State, and money already paid to the owner cannot be claimed back. This is why nominee structures (an Indonesian holds the freehold for you) are a serious risk.

Our translation: Every sale, exchange, gift, bequest and other act intended to transfer freehold directly or indirectly to a foreigner, to a citizen who also holds a foreign citizenship, or to a legal entity other than those set by the Government under Article 21(2), is void by law and the land falls to the State, provided that rights of other parties encumbering it continue and all payments already received by the owner cannot be claimed back.

Leasehold: a lease of someone else's land for building

The basic land law recognises a lease of land owned by someone else for building, paid to the owner, and a foreigner domiciled in Indonesia may hold it. A lease is a contract with the land owner, so check the owner on the land certificate, the length of the lease, and the written terms for extension.

Homes still being built may be sold through a preliminary sale agreement (PPJB) only after there is certainty on the land ownership, what is promised, the building permit, the infrastructure, and at least 20% of the housing built. Ask the developer for proof of each. This is the 2011 wording; the Job Creation law later amended parts of this law, so have a lawyer confirm the current text.

Indonesia · Permits

PBG is the building approval; SLF certifies the building is fit for use

PBG (Persetujuan Bangunan Gedung) is the permit given to the building owner to build. SLF (Sertifikat Laik Fungsi) is issued by the local government to state the building is fit for function before it can be used. Both run through SIMBG, the government's web system, so a real PBG can be checked there.

Pay only into the project's escrow account named in your contract, never to a personal or company operating account.

Any Developer who wishes to sell Units off-plan must submit to the Department a request to open an Escrow Account.
